Effective: June 9, 2026. This is a separately-versioned, separately-countersigned addendum to the standalone GrailGuard Coverage Policy. It exists to satisfy the Hughes v. UPS prong-2 "reasonable notice of the limit" requirement for high-value declarations where an inline booking-time checkbox is, by itself, insufficient evidence of bargained-for assent.

📋 When this rider is required

This rider is the mandatory signed addendum for any shipment with declared value above $250,000. There is no per-category subcap (no separate cap for art, jewelry, collectibles, manuscripts, or trading cards) — declared value applies to all categories. The rider is required because:

  1. Shipments with declared value above $250,000: declared values at this level exceed the standard per-tier coverage ceilings ($99K Metro; $249K Nationwide, International, and Animal-Nationwide) and approach the absolute $500,000 per-shipment cap. The Rider documents the Shipper's good-faith representation of value and the bargained-for assent to the declared-value cap on a high-value shipment.
  2. Shipments above the $500,000 absolute cap: require custom review in addition to this Rider. Email support@grailguard.io with item description, authentication documentation, and route before booking; a custom quote and addendum will be returned.

For declared values at or below $250,000, the Rider is not required — declared-value coverage applies automatically up to the per-tier ceiling and the booking proceeds with the standard release acknowledgments. If declared value is above $250,000, download, print, sign, and email the signed PDF to support@grailguard.io before pickup. GrailGuard will email confirmation when the signed rider is countersigned and on file.

  1. Print this page (or save as PDF via your browser).
  2. Fill in the booking tracking number, declared value, and item identification fields.
  3. Sign the Shipper Acknowledgment block in wet ink (or apply an electronic signature meeting E-SIGN §7001(c) requirements).
  4. Email the signed copy as a PDF attachment to support@grailguard.io with subject "Coverage Rider — signed copy".
  5. GrailGuard will email confirmation when the signed rider is on file. Pickup will not proceed for a booking above $250,000 declared value until the signed rider is received.

1. Purpose

This rider exists because the GrailGuard Coverage Policy uses a Released Value formation under Hughes v. UPS (CD Cal. 2008). One of the four Hughes prongs is "reasonable notice of the limit" — for very high-value declarations (above $250,000), a booking-time checkbox is, in case law, an inadequate substitute for an arms-length signed addendum. Major carriers (FedEx, UPS, DHL) use a parallel "Signature Required for High Value" or "Special Handling Authorization" rider for the same reason. This document is GrailGuard's equivalent. There is no separate category subcap — declared-value coverage applies to all item categories equally up to the declared amount and the absolute $500,000 cap. The per-tier self-serve ceilings do not apply to Rider-covered shipments — see §3.

2. Shipper representation

By signing below, the Shipper represents and warrants the following as of the booking timestamp:

  1. The Shipper is the owner of the item or holds the lawful right to ship the item;
  2. The item is identified accurately in the booking record (description, serial / certification number, brand, grade, and any other identifying details);
  3. The declared value entered at booking is the Shipper's good-faith estimate of the item's fair market value at the time of booking, based on a documented authentication, appraisal, or recent comparable sale; and
  4. If the item has been independently authenticated by PSA, BGS, SGC, or another nationally-recognized authentication body, the authentication documentation has been provided to GrailGuard or made available on request.

3. Coverage applied

Upon GrailGuard's countersignature acceptance of this rider, Released Value coverage applies to the declared value of the shipment, up to the absolute $500,000 per-shipment cap in Terms §11.

The standard per-tier self-serve coverage ceilings (Metro $99,000; Nationwide $249,000; International $249,000; Animal-Nationwide $249,000) do not cap a shipment covered by a signed and countersigned Rider. Those ceilings apply only to self-serve bookings with declared value at or below $250,000; a Rider-covered shipment (declared value $250,001-$500,000) is covered to its full declared value up to the $500,000 absolute cap, irrespective of tier.

This Section 3 applies the declared value as represented under Section 2 and does not waive GrailGuard's declared-value-accuracy and misrepresentation defenses: coverage remains subject to the Shipper's good-faith, accurate representation of value, and a material misrepresentation of declared value voids coverage as provided in the Coverage Policy.

For declared values above the $500,000 absolute cap, custom review is required in addition to this Rider and must be requested by email to support@grailguard.io before booking.

4. All other Coverage Policy terms remain in force

This rider is a Hughes prong-2 hardening addendum for high-value declarations only. All other terms in the Coverage Policy and Terms of Service — including the Hughes formation prongs, the §1668 carve-outs, the anti-stacking election in Coverage Policy §8 / Terms §11, the evidentiary presumption in Coverage Policy §5, the claim-filing windows, the exclusions, the arbitration agreement, and the class-waiver — remain in full force and effect.

5. Shipper Acknowledgment block

By signing below, the Shipper acknowledges receipt of, and assents to, the above terms. This rider may be signed electronically under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN, 15 U.S.C. §7001 et seq.) and the Uniform Electronic Transactions Act (UETA).

6. Carve-outs (always preserved)

Nothing in this rider limits or excludes GrailGuard's liability for (a) gross negligence, willful misconduct, or fraud, (b) personal injury or death caused by GrailGuard's negligence, or (c) any other liability that cannot be limited or excluded by applicable law (California Civil Code §1668; analogous non-waivable provisions of other applicable law).

7. Version + binding

This rider is at version 2.0-2026-06-09 (v1.0-2026-06-08 was the prior AoUV-subcap framing and is superseded; signed copies on file under v1.0 remain valid for their original shipment). Versioned text is archived; prior versions are available on request to legal@grailguard.io. The text fingerprint (SHA-256) is computed on page load and displayed in the header for independent verification by the Shipper and any subsequent claims-handler. The signed copy on file is matched to a specific version by the rider-version line in the GrailGuard countersignature block above.
